2021 Mercedes-Benz Perfect Drive Leaderboard Competition

Terms & Conditions.
 

By participating in the 2021 Mercedes-Benz Perfect Drive Leaderboard Competition (“the Competition”) you are indicating acceptance of the below terms and conditions

1. The Competition shall be under the management and control of Mercedes-Benz New Zealand Limited ("MBNZ") and PaR nz Corporate Events Limited (“PaR nz”), acting as the Tournament Committee (“Committee”).

2. Employees, their partners and associates of MBNZ and its related entities, employees of its authorised retailers, or its marketing partners are not eligible to participate in the Competition.

3. The Competition Period includes games played between 9.00am on Wednesday 22nd December 2021 and before 5.00pm on Tuesday 22nd February 2022.

4. Participants will have until 3pm Wednesday 23rd February 2022 to ensure all scorecards for games played during the Competition Period are entered into the DotGolf system. Any scorecard entered after this date will be deemed ineligible.

5. Participants must register for the Competition online before 5pm Tuesday 21st December 2021, to be eligible to take part.

6. Entries are limited to one per eligible participant. All registered participants will receive an electronic confirmation of entry.

7. Each participant consents to their name, club and retailer information to be displayed on the Competition Leaderboard alongside their three best scores. The Competition Leaderboard will be available only on the MBNZ website.

8. Participants will meet all costs in relation to their participation in the Competition including, but not limited to, club membership fees, Official Club Match entry fees and the cost to travel to and from each club event.

9. Participants must play in accordance with and abide by the Rules of Golf as issued by The R&A Ltd & USGA effective 1 January 2019 together with the Local Rules as issued on the day by the host golf club. Failure to do so may result in disqualification.

10. The Committee reserves the right to disqualify participants who are suspected of handicap violation. Amateur handicap infringements may be reported to NZ Golf.

Eligibility

11. In order for participants to be eligible to play in the Competition, certain criteria must be met. Participants must:
a. be over 18 years of age as at the date of participation;
b. hold a current New Zealand Handicap registered with New Zealand Golf Incorporated ("NZ Golf");
c. be an amateur golfer (as defined by The R&A Ltd and USGA http://www.randa.org/Amateur-Status/MainRules/1-Amateurism);
d. be the registered owner and/or primary driver, or husband, wife or de facto partner of same; of a New Zealand New Mercedes-Benz (as defined below) at the time of both the invitation and Competition unless MBNZ agrees otherwise in its absolute discretion;
e. meet any eligibility requirements of the host golf club;
f. register for the Competition at www.Mercedes-Benz.co.nz/perfectdrive before 5pm Tuesday 21st December 2021;
g. For participants to be eligible for a major prize they must submit a minimum of three (3) scorecards (as required under these terms and conditions) during the Competition Period.

12. A “New Zealand New Mercedes-Benz” is a new in New Zealand Mercedes-Benz passenger car, purchased from an authorised Mercedes-Benz Retailer in New Zealand and includes Demonstrator, Pre-Owned and Certified vehicles.

13. For customers that have purchased a New Zealand New Mercedes-Benz from an authorised Mercedes-Benz Retailer as:
a. individuals or sole traders, participants must be the registered owner, primary driver or spouse of same;
b. public or private companies or other entities, participants must be a registered director of the company, or a Retailer-nominated purchaser/fleet contact.

14. MBNZ may refer to the relevant vehicle offer and sale agreement and/or vehicle registration to determine in its absolute discretion whether a person is eligible.

Scoring and handicaps

15. Maximum handicap indexes are 36.0 for men and 36.0 for women as registered and verified within the NZ Golf DotGolf system as at the start of the Competition on 22nd December 2021.

16. The Competition format is a rolling cumulative total of the participant's best three individual Stableford scores entered into DotGolf during the Competition Period.

17. During the Competition Period participants can play at any golf club. If a club competition is not Stableford, then for the purposes of the Competition, DotGolf will automatically calculate the Stableford scores.\

18. Participants can play as many rounds of golf during the Competition Period as they wish, and only their three best score cards will be used for the purposes of calculating the Competition Leaderboard.

19. All rounds must be 18-holes for the scorecards to be eligible for the Competition and no 9-hole rounds will be counted.

20. DotGolf will automatically calculate each participants rolling best three Stableford scores and results will be posted weekly on the Competition Leaderboard.

21. Each participant consents to their scorecards being accessed through DotGolf system by PaR nz for the purposes of displaying their three best scores on the Competition Leaderboard.

22. Tie Breakers: in the case of two or more participants sharing the same cumulative Stableford score at the end of the Competition Period, a count-back system will be conducted as follows:
a. The winner is determined as the participant who scores the highest single Stableford score within the best 3 Stableford scores;
b. If there is still a tie, then the winner will be determined as the participant who scores the next highest single Stableford score within the best 3 Stableford scores and so on;
c. In the event that scores are still tied after comparing the best 3 individual Stableford scores then there will be joint winners of the Competition.

23. All Golf Club venues must input the scorecards of all participants who have current NZ Golf handicaps into DotGolf to ensure their handicaps reflect their true playing standard for future events.

Prizes

24. There are two (2) major prizes to be won in the Competition, each a one month-long vehicle loan of a Mercedes-Benz EQA (“the EQA”).

25. The two (2) major prizes winners will be determined as the top placed Male participant and the top placed Female participant at the end of the Competition Period (“the Winner/s”).

26. The Winners will be notified by phone and/or email.

Prize redemption

27. The EQA must be collected and returned by each Winner from an official Mercedes-Benz Retailer during normal business hours on a date agreed between the winner and MBNZ. Any costs associated with traveling to and from the location to collect and return the vehicle are the responsibility of each Winner.

28. If a suitable date for the EQA cannot be agreed between each winner and MBNZ within 4 months of the draw being made, the prize for that winner will be revoked, with no compensation payable.

29. The Winners, and any other driver authorised by MBNZ in its sole discretion to drive the EQA (if any), will be required to sign a vehicle loan indemnity form (in MBNZ's usual form) prior to collecting the EQA, with additional terms and conditions relating to the handling and treatment of that vehicle. The driver/s will be required to produce their full and current New Zealand driver’s licence at the time of vehicle collection. If the driver/s do not agree to such additional terms and conditions the Winner will be unable to claim the prize and no compensation will be payable.

30. If a Winner is unable or unwilling to redeem the prize:
a. the winner/s shall be deemed to forfeit the prize/s;
b. in no circumstances will the prize/s be redeemable as cash and neither MBNZ nor its Retailers, will be liable to compensate the participant in any way; and
c. MBNZ may, in its sole and unfettered discretion, elect to gift the prize/s to the next eligible place getter/s.

31. In the event a prize, or any part of a prize becomes unavailable for reasons beyond MBNZ’s control, MBNZ may substitute a prize, or part of the prize, of equal or greater value at their unfettered discretion.

General

32. Each participant in the Competition acknowledges and agrees that, to the extent permitted by law, MBNZ and MBNZ’s Retailers will not be liable to any participant (or to any person claiming through or on behalf of a participant) for:
a. any loss, damage, cost, or claim arising out of or in connection with any death or personal injury which is or may be suffered by any participant in connection with the Competition including as result of a breach of any consumer laws in New Zealand; and
b. any other loss, damage, cost, or claim arising out of or in connection with the Competition, of any nature whatsoever and howsoever occurring (whether in tort (including negligence), contract, under statute or otherwise).

33. If there is a dispute as to the identity of a participant, MBNZ reserves the right, in its sole discretion, to determine the identity of the participant.

34. Each participant acknowledges and agrees that, notwithstanding any other provision in these terms and conditions:
a. MBNZ reserves the right, in its sole and unfettered discretion, to cancel the Competition;
b. MBNZ reserves the right, in its sole and unfettered discretion, to change any of the participation criteria at any point; and
c. to the maximum extent permitted by law, neither MBNZ, nor any Retailer of MBNZ, will in any way be liable in respect of any loss or damage arising from any decision to cancel the Competition.

35. Any invitation to participate in the Competition is not transferrable or redeemable for cash.

36. The Competition is an amateur event and, as such, no prize money is awarded.

37. MBNZ collects personal information for the purposes of conducting the Competition. Participation is conditional on providing this information, which will be handled in accordance with the Privacy Policy available at www.mercedes-benz.co.nz. Participants can access and request correction of their personal information by contacting Mercedes-Benz New Zealand Limited at mbnz.enquiriesMBPC@daimler.com, Level 3 Office Tower, 277 Broadway, Newmarket or by calling +64 9 976 7500.

38. The participant hereby consents to MBNZ and its related companies and Retailers sending marketing and promotional material via electronic commercial messages (e.g. email or text messages) and using the participant's personal information for promotional, marketing, publicity, research, profiling and customer satisfaction purposes, including sending electronic commercial messages to the participant.

39. The Competition shall be under the management and control of the Competition organisers (comprising of a representative from PaR nz, and a representative from MBNZ) whose decision on all matters relating to the Competition shall be final and binding. The Competition organisers will decide all disputes, and notwithstanding anything to the contrary herein reserves the right to change any Competition condition.
